Judge Nixes Plan for Same-Sex Marriage Licenses

BERNALILLO — A judge on Tuesday slammed the door on a county clerk's plan to resume issuing same-sex marriage licenses after she agreed to stop doing so last month. Sandoval County Clerk Victoria Dunlap said she decided to resume the practice of issuing such licenses after reviewing state law governing marriage and deciding same-sex marriage is not precluded. "It's not in the law. There is nothing in the law that prohibits it," she said. Dunlap, a Republican who is not seeking re-election but is running instead for a county commission seat, said she had not decided whether to fight Tuesday's temporary restraining order against issuing same-sex licenses. State District Judge Kenneth Brown, who issued the order, set an April 2 hearing on a motion for a permanent injunction.
